Terms of Service
1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the OutClassAI software application, website, and related services (collectively, the "Service") operated by OutClassAI ("we", "us", or "our").
By creating an account, downloading the desktop application, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Your continued use of the Service after the effective date of a change constitutes your acceptance of the updated Terms.
2. Service Description
OutClassAI is an AI-powered copilot application designed to provide real-time, contextual support during live interviews, coding assessments, and professional 1:1 meetings. The Service runs as a desktop application on your device and uses artificial intelligence to detect conversational context and surface structured talking points.
The Service currently operates on Windows. macOS availability may be introduced in the future and will be communicated via the website and your registered email.
The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or that any particular feature will remain available.
3. User Responsibilities
You are solely responsible for how you use the Service. You must be at least 13 years old to use OutClassAI, and the Service is not directed to children. By using OutClassAI, you agree to:
- Comply with all applicable laws and the terms, rules, and guidelines of any platform, employer, recruitment agency, examination body, or interviewer you interact with.
- Determine independently whether using an AI thinking aid is permitted in any specific interview, assessment, or examination context before using the Service in that context.
- Not use the Service in examinations, certifications, or assessments where AI assistance is explicitly prohibited.
- Not use the Service to impersonate another person, provide fraudulent information, or engage in academic or professional dishonesty.
- Maintain the confidentiality of your account credentials and promptly notify us of any unauthorised use.
- Recording and consent. The Service may capture and transcribe audio from interviews and meetings, and may allow you to capture on-device screenshots or other visual content, in real time to provide suggestions and documents. You are solely responsible for obtaining any consent required from all participants and for complying with applicable privacy, wiretap, audio-recording, screen-recording, and surveillance laws in your jurisdiction and the jurisdictions of any participants. We do not monitor or verify whether you have obtained consent, and we are not responsible for any disputes, claims, or liabilities arising from unconsented recording, screen capture, or transcription.
You also agree not to use the Service to generate or attempt to generate:
- Illegal content or instructions to commit wrongdoing
- Hate speech, harassment, threats, or incitement to violence
- Malware, hacking instructions, or attempts to bypass safeguards
- Deceptive or manipulative content, including impersonation
- Content that violates third-party privacy or intellectual property rights
- Attempts to jailbreak or evade AI safety controls
OutClassAI is designed as a thinking and structure aid. Responsibility for how you apply any suggestions lies entirely with you.

For full details, please review our Refund Policy.
Currency. All prices are displayed and charged in Euros (€) unless otherwise stated.
5. AI Output Disclaimer
The Service uses large language model (LLM) technology. AI-generated outputs may be inaccurate, incomplete, misleading, or inapplicable to your specific situation. You must exercise your own independent judgement before relying on any suggestion provided by the Service.
We make no representation or warranty that use of the Service will result in job offers, employment, promotion, successful sales outcomes, or any other professional outcome. OutClassAI does not guarantee the accuracy, correctness, or suitability of any content it generates.
6. Third-Party Integrations
The Service is designed to run alongside, but not within, third-party video conferencing tools (such as Zoom, Google Meet, Microsoft Teams) and coding platforms (such as LeetCode, HackerRank, Codility, CodeSignal, CoderPad, HackerEarth). We are not affiliated with, endorsed by, or responsible for any of these third-party platforms.
The use of third-party identity providers (Google, Apple) for authentication is governed by their respective terms of service and privacy policies. We access only the information necessary to authenticate you and create your account.
We are not responsible for any changes to third-party platforms that affect the operation or undetectability of the Service.
7. Intellectual Property
All intellectual property rights in the Service — including the desktop application, website, source code, algorithms, brand, and documentation — are owned by or licensed to OutClassAI. Nothing in these Terms transfers any ownership rights to you.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.
You may not reverse engineer, decompile, disassemble, copy, distribute, resell, or create derivative works of any part of the Service.
8. User Content and Data
Local content and transient processing. Interview transcripts, audio, CVs, job descriptions, detected questions, and session context are captured and stored locally on your device. Portions of this content may be transmitted to OutClassAI backend services solely for real-time processing (such as generating live suggestions, contextual analysis, and tailored documents). OutClassAI does not permanently store raw interview transcripts or full CV text on its servers, does not use this content to train AI models or profile users, and does not sell it or share it with advertisers.
Account and usage data. We store your account identity, subscription details, usage metrics (minutes consumed, tokens used), and billing metadata on our servers. This data is used to operate the Service and is described in our Privacy Policy.
You retain all rights to any content you create or provide during use of the Service. By using the Service, you grant us no rights to your content beyond the limited transient processing necessary to provide the Service.
9. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
10. Termination
You may close your account at any time by contacting us at support@OutClassAI.app.
We may suspend or terminate your access to the Service immediately if you breach these Terms, engage in prohibited conduct, fail to pay applicable fees, or for any other legitimate reason with reasonable notice where practicable.
On termination, your right to use the Service ceases immediately. Sections 5, 7, 11, 12, 13, 14, and 16 survive termination.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) €50 FOR FREE-TIER USERS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless OutClassAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

These Terms are governed by the laws of Spain. Any dispute arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rights you may have under applicable law.
If you are a consumer resident in the European Union, you may have access to national consumer protection and out‑of‑court dispute resolution bodies under applicable law. You can find information about consumer dispute resolution bodies in the EU, Norway and Iceland on the official Consumer Redress in the EU website.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email to your registered address and/or a notice within the Service. If you disagree with the revised Terms, you may cancel your subscription before the new Terms take effect.
